In Quebec, if two people put forth an offer to purchase and one is at the asking price and the other is more, does the vendor have to sell his property to the buyer who offered the asking price or can he sell to the buyer who offered more?

    A Seller can accept, reject or counter any offer, regardless of price. Usually there are other considerations as well such as Completion Date, other conditions and requests for inclusions.

    Under the old laws in Québec, a seller that received an offer with the same price, inclusions and conditions as in his listing agreement, he was obliged to sell the property - with the exception of a bidding war. Since the implementation of Bill 73 last year, a seller has the right to accept or reject any offer that he has received. If he should receive multiple offers, including one that is higher than the asking price, he is welcome to accept any offer that meets his ideal conditions and his ideal pricing.

    You can accept the best offer until you didn't make a contract (written or not) that you promise to sale your house with the first who came by example!

    The Vendor can sell it to the buyer who offered more in Quebec. Remember there is a clause that states the asking price is an invitation to submit a promise to purchase to the vendor. But does not legally bind the Vendor to the Buyer. In other words the seller can sell it to the highest offer even if it's higher than the asking price! You can contact me at 514.562.9557
