Follow-up - if someone saw my house with my previous agent (or any agent) - how would I know (I'd know if they made an offer)

    I can't see any merit for your agent to hide or NOT present your offer as required. You'd know, that's for sure!

    David, its not customary for sellers to know the names of the potential buyers that come to view your home. The only way you would know that, is if they presentat an offer to you.

    When an appointment is made by an agent to view your home, you usually know the name of the agent, the brokerage he/she is representing, and what day and time the appointment is scheduled.

    If someone would have an offer, they would register the offer with the Brokerage/office through which you have listed the house. The office collects all the information about every single showing of your house by all agents and you can request to review the list at anytime: usually your Realtor would review the number of showings with you on a weekly basis.

    Hi David,

    Real Estate professionals in Ontario MUST abide by a very strict Code of Ethics and Rules and Regulations as set out in the Real Estate and Business Brokers Act (REBBA 2002).(www.reco.on.ca) It clearly states that the Listing Agent must communicate all offers to the Seller as soon as possible.
    It sounds like you may have recently changed Sales Representatives. Regardless of this, if there was a bonafide offer, you would have seen it.

    Ne Vous inquietez-pas. Your Broker is the person who will do the follow-up with the possible Buyer's Broker or with the Buyer directly if he contacted your listing Broker directly.

    For any reason there will be a Promise to Purchase not presented to you.

    You probably would have no way to know. Is this question because a person is showing interest in your home after expiry? If this is the case you should check out the holdover clause of your listing agreement. The other concern would be if they have a Buyer Agency Agreement signed. While this does not directly affect you. The Buyer may be liable to pay their Agent a commission. In any of these instances I suggest checking with your lawyer.

    Hello David, you would not know unless they put in an offer therefore if selling your home privately after it has been listed with a realtor... you should ask the buyer if they have seen your home with an agent or inquired about it prior to you putting it up privately. If they have you may have to pay commission if the holdover has not expired.

    If this is about your liability under the Listing's holdover clause, ask/insist that the Buyer imdemnify you against any liability from that listing's holdover clause responsiilities

    I'm assuming your home was listed with an agent, then it was either cancelled or expired and you re-listed with a different agent. You're now wondering if a buyer who saw your home saw it with the original agent or the second agent to determine which of the agent gets paid for the sell of your home. You have look at the holdover date and then somehow determine when the home was viewed and by who. It can get dicy, you might want to consult with your lawyer
