If my offer is conditional upon financing until Thursday, Jan 5, 20xx, when does it expire? Thursday or Friday?

    When an offer is conditional upon financing, there would either be a time stated ie. until 6pm. Thurs. Jan. 20xx, or it would be until the end of that particular banking day...therefore still approx. 6pm. Thurs. Jan.5, 20xx.

    I disagree a little with the above comment. If there is no time stated then it would expire at 11:59pm on Thurs.

    Your condition on the agreement has to be stated exactly by time & date.
    Also is the condition waived by default or acceptance? Usually its by waiver but there are cases where the clause is written that its accepted by the due date if not waived off.
    This is a contract and your terms has to be stated clearly and defined. If its vague, you will have issues.

    Great Question!
    The condition in your contract should have a specific time and date before it expires. However, if there is no specified time on Thursday, then it will expire at 11:59 p.m. Thursday evening.

    You are required to post a time of expiry of your offer - and this can be very important when a property is fresh to the market and you hope to get the seller to look at your offer. By putting in a short time period, you hope to get the sellers to work with your offer before other offers are registered.
    Also a note on conditions. Another agent wrote about "waiving the conditions" - if an agent is doing their work properly, you should sign a "fulfillment of conditions" rather than a waiver. By signing a waiver, your conditions like home inspetion, are completley removed from the deal. If you did the home inspection, and you are satisfied with it, then you should sign a fulfillment, because your condition was fulfilled...not a waiver.

    The answer may lie in the province's real estate contract itself. The other answers here are correct, that if no time for the date of expiry was written in the contract, it would be 11:59 pm of that date. Our Alberta Real Estate Association contracts have a set time of 9:00 pm on the date of the condition for notice of waiver to be given. It could be changed by both parties, but this way a time is already identified.

    The Offer has an Irrevocable time and date on the first page. The time and date defines when it expires.

    Usually, time is of the essence.

    This offer expires at exactly 12:00 pm on Thursday night, NOT 1 minute or even 10 seconds before, and it is dead 0.01 seconds after 12:00 pm.

    How you actually prove that the condition was removed 10 seconds before the deadline is the real issue. This could result in legal action.
    As a seller, you must make sure that, no subject removal has been sent directly to you, your realtor, your realtor’s office or their HQ. The real estate brokerage that represents you is deemed your agent and notice to them, anytime prior to the deadline is valid notice.

    The only way to ensure that you do not sell your property to two people is to get a signed release from the defaulting buyer!

    Rick is right, the offer expires at exactly 1200pm Thursday. No any earlier. But in practice, you will need to get the removal into the other realtor, or brokerage earlier. It would be very inconsiderate to attempt to contact the other agent at 1130pm to deliver the removal. If you know that you can't remove the condition when the bank is closed, the facts won't change after that.

    If you have an offer or are making one, your agent should be carefully timing all the conditions, so you are not left without a deal, should something expire and you are out of reach. Always talk to your agent first. Back dating or timing the paperwork is not legal or ethical. You can see there is a timed acknowledgement, to keep the record straight!
